How do I get indemnification?

You determine the amount of the direct loss you have suffered and provide evidence that one of your employees or another person in a position of trust was responsiblefor causing the loss.

The easiest way to provide evidence of the loss is

  • a written confession – wherever possible attested by a notary public

  • a legally enforceable acceptance of debt under civil or labour law

  • submission of a legally unappealable judgement of a criminal court giving details of the grounds and the amount of the compensation owed by a named perpetrator

  • other evidence such as, e.g. submission of reports by internal auditors, documents constituting conclusive proof (receipts), evidence from independent witnesses etc.
But it is not necessary in every case to identify the perpetrator. If you can provide us with documentation which proves that, on the overwhelming balance of probabilities, the loss can only have been caused by a wilful unlawful act committed by somebody working for you, we will still pay your claim, less the self-retention for your own account agreed with you in your policy.
